Terms and Conditions

The user expressly accepts these General Terms and Conditions, which shall govern the contractual relations established between the User and the entity Golf Park Entertainment Mallorca S.L.U., with VAT number B-82690819 and registered office at Palma-Mallorca, Ctra de Sineu, Km 10 Palma Illes Balears, regarding the green fee sales service through the website tgolfpalma.golfmanager.com.

The booking engine of Golf Park Entertainment Mallorca S.L.U. uses technology from Golfmanager (Golfmanager S.L.).

These General Terms and Conditions have been prepared in accordance with the provisions of Law 7/1998 on General Contracting Conditions, Law 26/84 for the Defense of Consumers and Users, Organic Law 15/1999 on the Protection of Personal Data, Law 7/96 on the Regulation of Retail Trade, Law 34/2002 on Information Society Services and Electronic Commerce, and other applicable legal provisions.

1.- Service Terms:

By accepting these General Terms and Conditions, the User/Customer expressly accepts full and unreserved adherence to them, as well as to the Particular Conditions governing the use of the contracted services, declaring they have the legal capacity to contract the services offered through the website. This document may be printed and stored by users, who may also request any clarification regarding its content at the telephone number +34971797330 or at the email address palma@t-golf.club.

Golf Park Entertainment Mallorca S.L.U. may at any time and without prior notice modify these General Terms and Conditions by publishing such modifications on its website so they may be known by Users. Upon publication of the modifications on the website, the duty to notify Users shall be deemed fulfilled.

To access the contracting of services offered on the website, the User must previously complete all data requested in the form established for this purpose and press the acceptance button.

2.- Contract Formation Procedure:

2.1 Contract Formation:

The parties expressly declare that the acceptance of the offer from Golf Park Entertainment Mallorca S.L.U. selected by the User/Customer shall occur upon completion of all steps of the contracting procedure detailed on the website, which implies full and express acceptance of these conditions, including the mandatory insurance of 3 euros per day for players not federated in Spain.

The contract shall be perfected when the banking entity associated with the credit card provided by the Customer authorizes the transaction. At this moment, a confirmation page of the booking made will appear, which may be printed as proof thereof.

By accepting the contract, the customer expressly accepts both the general rules of play required by the Royal Spanish Golf Federation and the particular ones determined by the golf course where the customer acquires the green fee.

The conditions and rates of the services offered are those listed on the website at the time of contracting them. Golf Park Entertainment Mallorca S.L.U. may freely modify rates without prior notice by publishing them on the website. These rates shall include VAT or the tax that may replace it, at the tax rate established in each case by current legislation.

2.2. Golf Services:

The user/customer must respect the operating and organizational rules set by the golf course. Acceptance of the offer by the user implies express acceptance of these rules. In the contracting of golf services, the federation regulations governing this sport must be especially taken into account, particularly the following issues:

• Handicap: A maximum handicap may be required from the player (28 for gentlemen and 34 for ladies), which must be proven at the time of booking as well as on the course itself.
• Green fees: Green fee prices published on the website may undergo variations in case of changes to the rates in force at the date of issue by the Golf Course.
• Cancellation of the green fee contracted by the user between 0 and 7 days before the game will incur charges of 100% of its cost; cancellation more than 8 days before the game date will be free of charge.
• In case of non-appearance at the course at the fixed time and day, the user shall not be entitled to any refund (100% charge of the booking).
• If the agreed services cannot be provided due to force majeure (adverse weather, course closure, repairs, etc.), the amount paid will not be refunded under any circumstances; the possibility of changing the booking to play another day within a period of 30 days from the booked date will be offered.

4.- Privacy and Protection of Personal Data:

By providing the personal data requested in the contracting process, including the email address, Users/Customers grant permission for these addresses to be processed and, furthermore, used to send commercial communications for promotion or advertising of the services and products offered by Golf Park Entertainment Mallorca S.L.U. Users may at any time contact the email address palma@t-golf.club to revoke the consent given.

Golf Park Entertainment Mallorca S.L.U. declares that it complies with current regulations regarding data protection, particularly Organic Law 15/1999, of December 13, on the Protection of Personal Data, allowing Users to exercise their right of access, rectification, and cancellation of the data provided through the contact means referred to in the previous paragraph. They may also consult the company's privacy policy under Privacy.

5.- Cancellation Policy:

• Cancellations between 0 and 7 days before tee time: 100% of the booking will be charged and is non-refundable.
• Cancellations more than 8 days before tee time: 100% of the booking will be refunded.
• Bookings of special offers and promotions are not exchangeable or refundable under any circumstances, nor will any type of discount be applied to special offers.

6.- Applicable Law and Dispute Resolution:

These General Terms and Conditions shall be governed by Spanish law. In the event of any type of discrepancy or claim between the parties regarding the fulfillment or content of these General Conditions, the parties submit to the Courts and Tribunals of Palma de Mallorca.
